Terms and Conditions 1. Please read this entire agreement carefully before purchasing any tour from TimeforTours.com. 2. By becoming a customer of TimeforTours.com, you acknowledge that you have read, understood, and agreed to the following "Terms and Conditions." The use of TimeforTours.com, means you have accepted this agreement in its entirety. 3. If one part of this agreement is considered unefforcable that shall not nullify the entire contract. 4. TimeforTours.com reserves the right to change the Terms and Conditions at any time with out prior notice. Eligibility 5. You must be at least 18 years of age. If you are not 18 years of age you must have parental consent to book a tour. Privacy 6. TimeforTours.com is the sole owner of the information gathered in the tour booking process. TimeforTours agrees not to sell or share you information with anyone who is not considered on a "need to know" basis. 7. Gathered information includes but is not limited to: name, address, phone numbers, e-mail addresses, and payment information 8. You will be required to set up a username and password to use TimeforTours.com. It is your responsibility to store this information securely and not share it with anyone. Tour Cancellation and Changes 9. Tour providers reserve the right to cancel tours for any reason including: weather, transportation, riot, and inadequate numbers to fill the tour. 10. Tour providers will refund the payment or offer a voucher in these very rare circumstances. Passports 11. It is the responsibility of all passengers to check with the consulate of the country where they are visiting for current entry requirements. Visa and Health requirements are subject to change without notice. 12. It is our recommendation that you purchase a Travel Insurance Policy prior to departure. If you cancel your trip or significantly alter travel dates, many policies will reimburse the cancellation fees and related expenses. Pricing & Inclusions/Exclusions 13. Prices listed on TimeforTours.com are per person unless otherwise specified. 14. Prices are subject to change due to availability. Prices may be higher during holiday seasons. 15. Prices quotations are may change without notice, until a booking is confirmed. 16. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax. 17. Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under “Inclusions” on the product pages of TimeforTours.com. Payments and Chargebacks 18. TimeforTours.com currently accepts Visa and Mastercard. 19. You may submit your payment through our secure website or call in your payment over the phone if you desire. 20. Your agree that TimeforTours.com does business electronically by email, so email is accepted as the form of delivery of the services by TimeforTours.com. 21. You agree not to dispute a credit card charge on the basis of services not rendered if TimeforTours.com can prove that the E-Ticket was sent by email (by providing proof that the email was send), by fax (by providing a copy of the transmission record showing the fax was successfully sent to the fax number provided), by mail (by providing a signed statement by the person who deposted the E-Ticket in the United States Postal Services). 22. You acknowledge that TimeforTours.com is owned by Prestige Marketing Group, Inc., a Colorado Corporation. 23. You agree not to dispute any charge improperly. This includes filing charge backs for unrecognized names, including but not limited to Prestige Marketing Group or TimeforTours.com. 24. In the event you improperly file a charge, you agree to pay the amount of the disputed charge plus a $250 chargeback fee. 25. In the event you file a charge improperly you agree to provide a written statement to the credit card company confirming the charge is correct. 26. In the event legal actions is necessary, you agree to pay TimeforTours.com legal fees if TimeforTours.com wins the lawsuit. Cancellation Policy 27. Upon purchasing you tour online, TimeforTours.com will set the reservation for you. If TimeforTours.com cannot set the reservation, 100% of your money will be refunded. TimeforTours.com shall not be held responsible for any loss that might arise from such an inconvienance. 28. You may cancel at any time, however, you will be held to a cancellation fee according to the following schedule 7 days before the departure date- 100% of the reservation cost 8-14 days before the departure date- 50% of the reservation cost 15-29 days before the departure date-25% of the reservation cost 30 or more days prior to the departure date- 10% of the reservation cost 29. No refunds shall be may for portions of the tour that are unused. 30. Some tours require a minimum number of people to operate. The affected customer will be fully refunded or may choose a tour of equal value as a substitue. This is very rare that this should occur. Disclaimers & Limitations of Liability 32. Under no circumstances will TimeforTours.com or its agents, affiliates, service providers, suppliers, and/or distributors be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of TimeforTours.com regardless of the form of action. 33. TimeforTours.com and its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of individual customers, shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours. 34. Furthermore, TimeforTours.com and its agents and suppliers accept no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control. 35. TimeforTours.com’s content - including the information, names, images, pictures, logos, prices, dates, and availability regarding or relating to TimeforTours.com, TimeforTours.com and/or to a TimeforTours-affiliated website, service provider, operator and/or distribution partner – is provided “AS IS” and on an “AS AVAILABLE” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. 36. At TimeforTours.com we check and recheck the details about all the products and services we offer for accuracy. However, TimeforTours.com does not warrant that functionality, content or information contained on TimeforTours.com or any TimeforTours-affiliated website will be uninterrupted or error free, that defects will be corrected, or that TimeforTours.com or the servers that make it available are free of viruses or bugs. 37. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable. Choice of Law, Waiver, and Claims 38. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without reference to conflicts of law rules. 39. As a condition of the use of the TimeforTours.com website and service, you (the Customer) agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Boulder County, Colorado and therefore agree to file any grievance or suit of any kind exclusively in the courts located within the county of Boulder. 40. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between TimeforTours.com and the product providers or between TimeforTours.com and any other of its Corporate Partners. Neither the product providers nor any Corporate Partner shall have the ability to create any obligation on TimeforTours.com’s behalf. 41. This Agreement constitutes the entire agreement between you and TimeforTours.com with respect to the using TimeforTours.com. |
